Terms of Service

1. Agreement and Operator

These Terms of Service are an agreement between you and Vunel, the operator of the Vunel mobile application and related services (together, the “Service”). By creating an account or using the Service, you accept these Terms. If you do not agree, do not use the Service.

Our Privacy Policy explains how we handle personal information and is part of your decision to use the Service.

2. Eligibility

You must be at least 13 years old to use the Service. If you are below the age of majority where you live, you must have a parent or legal guardian’s permission to use it. You must provide accurate profile information when you choose to add it and use the Service only where doing so is lawful.

3. The Service and License

Vunel helps you collect and revisit vanity layouts. You can record makeup and perfume items, their dimensions and use frequency; mark mirror clearance and drawer movement; arrange items on a measured surface; and save dated layouts for later comparison and reuse.

Subject to these Terms, Vunel grants you a limited, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial purposes on Apple-branded products that you own or control, as permitted by the Apple Media Services Usage Rules, including applicable Family Sharing rights. No other rights are granted.

4. Accounts

You need to sign in to use the Service. The app uses a device-based identifier to establish your session; it does not require an email address, password, or Apple sign-in. Keep your device secure and tell us promptly if you suspect unauthorized use. You are responsible for activity under your account unless applicable law provides otherwise.

Profile details, item cards, Studio drafts, and saved layouts are stored in your private server records and cached on your device for editing. Posts you publish to the Square are stored online and visible to other users. You can review and change supported records in the app. The in-app account deletion control deletes your server records for your profile, Square posts, items, draft, and saved layouts, then clears local account data and signs you out. Uploaded files may remain in storage because the current upload service does not provide file deletion. We may retain limited information when law requires it or for legitimate security and dispute purposes, as explained in the Privacy Policy. For further data requests, contact Vunel@gmail.com.

5. Acceptable Use

You agree not to:

• reverse engineer, copy, modify, or bypass security or technical limits of the Service, except where applicable law permits;
• resell, sublicense, or commercially exploit the Service or purchased coins;
• attack, overload, scrape, disrupt, or gain unauthorized access to the Service or other accounts;
• upload unlawful, infringing, deceptive, or harmful material, or use another person’s content without permission;
• harass others, impersonate another person or organization, or misrepresent your identity; or
• use the Service in violation of applicable law or applicable third-party terms.

6. Your Content

You keep the rights you have in photos, item details, measurements, notes, and layouts you submit. You grant Vunel a limited, non-exclusive license to host, process, display to you, back up, and transmit that content only as needed to provide, secure, and improve the Service in accordance with the Privacy Policy. You are responsible for having the rights to submit it and for its accuracy.

As between you and Vunel, you may use the placement maps and explanations generated for your account for lawful personal purposes. Vunel retains its rights in the app, software, and service materials. You are responsible for reviewing your inputs and deciding whether and how to use a suggested layout.

7. Purchases

The first three arrangements are free. After that, each new or revised arrangement uses 14 coins. Coins are acquired through one-time consumable in-app purchases at prices shown in Apple’s purchase flow. Coins have no cash value, cannot be transferred or redeemed for cash, and are used only within the Service.

This app does not offer any subscription, recurring payment, or auto-renewing service. All purchases are one-time consumable in-app purchases.

Apple processes payments and handles refunds under its App Store policies. Purchase availability and consumer refund rights may vary by location. Nothing in these Terms limits rights that cannot lawfully be waived.

8. Intellectual Property and Copyright Complaints

The Vunel name, app, software, interface, and service content other than your content belong to Vunel or its licensors and are protected by applicable intellectual-property law.

If you believe content in the Service infringes your rights, email Vunel@gmail.com with your name and contact information; identification of the protected work; the location of the material at issue; a statement that you believe in good faith that the use is unauthorized; a statement that your notice is accurate and that you are authorized to act for the rights holder; and your physical or electronic signature. We will review complete notices and act as required by applicable law.

9. Third-Party Services

The Service relies on Apple for distribution and in-app purchases. Those services operate under their own terms and privacy practices. You must comply with applicable third-party terms when using Vunel. To the extent permitted by law, Vunel is not responsible for independent third-party services or outages outside its control.

10. Termination

We may suspend or terminate access if you materially breach these Terms, misuse the Service, or create a security or legal risk, subject to applicable law. You may stop using the Service at any time and may request account deletion as described above. Termination ends your license to use the app; provisions concerning content rights needed to complete deletion, intellectual property, purchases already made, disclaimers, liability, indemnification, disputes, and general terms survive as appropriate.

11. Disclaimers

To the extent permitted by applicable law, the Service is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, express or implied. We do not guarantee uninterrupted availability or that a suggested placement will fit every physical item or space. Any warranties or consumer rights that cannot legally be excluded remain in effect.

12. Limitation of Liability

To the extent permitted by applicable law, Vunel is not liable for indirect, incidental, special, consequential, or punitive losses, or for lost profits, data, or business opportunities arising from the Service. To the extent a monetary cap is permitted, Vunel’s aggregate liability for all claims relating to the Service will not exceed the greater of the amount you paid for the Service during the 12 months before the claim or US$50. These limits do not apply where prohibited by law, including to liability that cannot be limited or to mandatory consumer rights in your location.

13. Indemnification

To the extent permitted by law, you will indemnify Vunel against third-party claims and reasonable costs arising from your material breach of these Terms, unlawful use of the Service, or infringement of another person’s rights through content you submit. This provision does not require you to cover losses caused by Vunel’s own conduct or waive mandatory consumer protections.

14. Governing Law and Disputes

These Terms are governed by the law applicable to the dispute under the rules of the court with jurisdiction, without displacing mandatory consumer protections that apply where you live. Before filing a claim, either party may contact the other to seek an informal resolution for 30 days. If no resolution is reached, disputes may be brought in a court of competent jurisdiction under applicable law. Nothing here removes a right to a local consumer forum or remedy that cannot lawfully be waived.

15. Apple App Store Terms

For the iOS app, you and Vunel acknowledge that these Terms are between you and Vunel, not Apple. Vunel, not Apple, is responsible for the app and its content. The license is limited to use on Apple-branded products you own or control, subject to the Apple Media Services Usage Rules and applicable Family Sharing, volume purchasing, or Legacy Contacts rights.

• Vunel alone is responsible for maintenance and support; Apple has no obligation to provide them.
• If the app fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price of the app. To the maximum extent permitted by law, Apple has no other warranty obligation. Vunel is responsible for other warranty claims that cannot be disclaimed.
• Vunel, not Apple, is responsible for addressing claims about the app or your use of it, including product liability, legal or regulatory compliance, privacy, and consumer-protection claims.
• If a third party claims that the app or your use of it infringes intellectual-property rights, Vunel, not Apple, is responsible for investigating, defending, settling, and discharging that claim.
• You represent that you are not located in a region subject to a U.S. Government embargo or designated by the U.S. Government as a terrorist-supporting region, and that you are not on a U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you after you accept them.

16. Changes to These Terms

We may update these Terms as the Service or law changes. We will revise the Last updated date above and notify you in the app of material changes before they take effect where required. By continuing to use the Service after updated Terms take effect, you accept them. If you do not accept an update, stop using the Service and request account deletion.

17. General

If a provision is unenforceable, the remaining provisions stay in effect. These Terms and the Privacy Policy are the entire agreement concerning the Service, except for terms that applicable law requires. A failure to enforce a provision is not a waiver. You may not transfer your rights or obligations without our consent; we may transfer ours in connection with a legitimate business transfer, subject to applicable law and your rights.
